• Prohibits unit owners' associations in common interest communities from regulating the use of public rights-of-way by property owners or local governments.

• Requires associations to permit use of public rights-of-way in accordance with local government ordinances, resolutions, rules, franchises, licenses, or charter provisions.

• Prevents associations from requiring that public rights-of-way be used in any particular manner.

• Defines "local government" as statutory or home rule counties, municipalities, or city and counties.

• Takes effect at 12:01 a.m. the day after the ninety-day period following final adjournment of the general assembly, unless subject to a referendum petition filed within that period.
