HB 22-1142 Summary

• Creates an extended service hours permit allowing specified alcohol licensees to operate during expanded hours: either 5:00 a.m. to 2:00 a.m. or 7:00 a.m. to 4:00 a.m. (but not both).

• Eligible licensees include sales rooms, beer and wine licensees, hotel and restaurant licensees, taverns, brew pubs, clubs, arts venues, racetrack licensees, distillery pubs, and fermented malt beverage retailers, among others.

• Requires applicants to obtain permits from both state and local licensing authorities concurrently, with local authorities having discretion to deny extended hours within their jurisdiction.

• Prohibits state licensing authority from issuing or renewing permits to licensees with any state or local disciplinary action in the twelve months preceding application, with an exception for businesses operating fewer than twelve months.

• Establishes annual permit renewal concurrent with underlying license renewal and allows state licensing authority to promulgate rules for implementation and permit creation; takes effect 90 days after final adjournment unless subject to voter referendum in November 2022.
