HB22-1144: Naturally Acquired Immunity Equity and Inclusion Act

• Requires employers and state agencies that impose COVID-19 vaccine or testing requirements to accept documentation of naturally acquired immunity as an alternative to vaccination or testing.

• Defines naturally acquired immunity as having contracted SARS-CoV-2, recovered with naturally occurring antibodies, or received monoclonal antibody treatment, encompassing natural progression to humoral immunity.

• Accepts either documentation of a positive COVID-19 test or serology and T cell testing (or other emerging technologies) proving previous SARS-CoV-2 infection, with documentation dated after March 1, 2020.

• Creates new statutory provisions under Colorado Revised Statutes 8-2-131 for employment requirements and article 3.3 of title 24 for state agency requirements.

• Takes effect 90 days after final adjournment of the general assembly, or following voter approval in November 2022 if a referendum petition is filed.
