HB22-1201: Standards for Immunization Requirements

• Allows individuals to claim exemption from any immunization requirement if the vaccine lacks full FDA approval, has only received emergency use authorization, or the manufacturer is not liable for injuries or deaths caused by the vaccine.

• Permits exemptions if the pivotal clinical trial used for FDA approval did not evaluate safety for at least one year after administration against a control group receiving a placebo or alternative FDA-authorized vaccine.

• Requires the Department of Public Health and Environment to post on its website the criteria for claiming immunization exemptions and information about injuries or diseases caused by each required immunization and their occurrence rates.

• Mandates the department publish whether the risk of permanent disability or death from required immunizations has been proven to be less than the risk from the diseases they prevent.

• Applies to immunizations required as conditions of employment, school attendance, or for obtaining licenses, certifications, registrations, or degrees.
