HB 22-1218 Summary

• Requires builders of new single-family detached residences to offer buyers options for solar prewiring, solar thermal systems, water-efficient fixtures, and pressure-reducing valves, with offers made according to construction schedule.

• Mandates builders offer buyers pricing and energy efficiency information for electric vehicle charging systems, efficient electrical heating systems (heat pumps, electric water heaters, boilers, or furnaces), and related wiring upgrades.

• Requires new multifamily buildings and large commercial buildings (25,000+ square feet) constructed or substantially renovated after July 1, 2023, to include electric vehicle infrastructure: 50% EV-capable and 20% EV-ready spaces in multifamily buildings; 25% EV-capable and 10% EV-ready spaces in commercial buildings.

• Allows builders to subject upgrades to standard terms and conditions, select contractors, and include technology limitations clauses in purchase agreements; protects builders from liability for third-party installations or future compatibility issues.

• Takes effect 90 days after legislative adjournment, subject to voter approval in November 2022 if a referendum petition is filed; does not apply to model homes, sales inventory, or manufactured homes.
