HB22-1348 Summary

• Requires manufacturers, disclosers, and operators to disclose specific chemical information (names and Chemical Abstracts Service numbers) for products used in oil and gas downhole operations to the Colorado Oil and Gas Conservation Commission, effective July 31, 2023.

• Mandates the Commission create and publicly post chemical disclosure lists for each well site on a searchable website, excluding trade product names and chemical quantities to protect proprietary formulations while ensuring chemical identities are disclosed.

• Requires operators to provide chemical disclosure lists to nearby property owners (within 2,640 feet), schools, emergency services, local governments, public water systems, and wildlife agencies within 30 days of receiving the list from the Commission.

• Prohibits PFAS chemicals (perfluoroalkyl and polyfluoroalkyl substances) from being intentionally added to chemical products used in oil and gas operations through required written declarations.

• Appropriates $123,000 for the 2022-23 fiscal year to the Department of Natural Resources and Governor's Office of Information Technology to implement the disclosure system.
