• Permits employees of supervised lenders to work from remote locations (private residences or other employee-approved locations) subject to administrator rules and multiple safeguards.

• Requires remote-working employees to maintain secure data safeguards including virtual private networks (VPNs), conduct no in-person customer interactions at remote locations, and receive training on confidentiality and privacy.

• Mandates that lenders establish risk-based monitoring of remote work, maintain records of oversight processes, keep consumer information and records off-site, and ensure records remain accessible for regulatory examination.

• Removes the requirement for debt-management services providers to submit criminal history record check results for all employees or agents, limiting the requirement only to those authorized to initiate trust account transactions.

• Takes effect 12:01 a.m. on the day following the ninety-day period after final adjournment, subject to referendum petition procedures and approval by voters if challenged.
