Expands Colorado's pretrial diversion program to specifically identify and divert defendants with behavioral health disorders from the criminal justice system into community treatment programs.

Requires district attorneys using state money for diversion programs to consider whether defendants have mental health or other behavioral health disorders when determining eligibility.

Permits diversion agreements to include provisions requiring defendants to receive treatment for behavioral health disorders as a condition of diversion.

Allows probation departments or approved community treatment programs to assess defendants' behavioral health needs and direct them to participate in therapeutic, medical, educational, and other rehabilitative services.

Takes effect 90 days after final adjournment of the general assembly, subject to voter approval at the November 2022 general election if a referendum petition is filed.
