Senate Bill 22-074 Summary

• Transportation commission must annually contract with a fairness monitor to review procurement processes for transportation projects using alternative contracting methods (any method other than traditional design-bid-build).

• Fairness monitor must review projects before use of alternative contracting to determine cost/timeline benefits, examine decision-making processes, oversee contractor selection fairness, and report recommendations to a newly created contracting fairness committee.

• Committee composition includes two transportation commission members, department executive director and chief engineer, one House and one Senate member, and one Colorado Contractors Association representative.

• For projects using alternative contracting, fairness monitor designates third-party team to monitor procurement fairness; department pays team costs and imposes equal fees on all bidding contractors to generate 50% of monitoring costs.

• Upon project completion, fairness monitor must review and report actual costs and schedules against original budgets and record any claims, disputes, or litigation arising from the project.
