SB22-136: Special District Governance

• Extends initiative and referendum powers to electors of special districts, governed according to Article 11 of Title 31, with district implementation required to facilitate rather than obstruct these rights.

• Requires developer-affiliated boards to send meeting agendas and board packets to all residents by regular mail and email along with a separate statement disclosing the board's conflict of interest with residents.

• Mandates developer-affiliated boards to send self-nomination forms to all residents with each agenda and board packet, allowing residents to nominate themselves for board positions.

• Requires immediate appointment of any resident who submits a self-nomination form to fill a developer-affiliated position, which is immediately terminated upon receipt of the nomination form.

• Mandates the board to call a special election to fill all developer-affiliated positions if self-nomination forms are received from more residents than available board positions.
