Senate Bill 22-191 Summary

• The Office of Information Technology SHALL initiate procurement of IT resources for state agencies, but state agencies may initiate their own solicitations and contracts only with prior written approval from the procurement official, with a 30 business day deemed approval timeline if no response is received.

• Establishes a $50 million cap on the Technology Risk Prevention and Response Fund balance, with up to 50% of the beginning fiscal year balance continuously appropriated to the office, and allows the office to contribute operations and maintenance fees to the fund.

• Unexpended and unencumbered money appropriated from the General Fund for IT procurement in fiscal year 2022-23 and thereafter shall not revert to the General Fund but shall be transferred to the Technology Risk Prevention and Response Fund on July 1st annually.

• Software application licensing contracts designed for generally available desktop or server hardware cannot restrict governmental bodies' ability to install or run the software on hardware of their choosing, effective upon the bill's enactment date.

• Declares the act necessary for the immediate preservation of public peace, health, or safety.
