Senate Bill 22-203 Summary

• State Department of Health Care Policy and Financing, in conjunction with the Department of Public Health and Environment, must develop a regulatory plan for PACE (Program of All-Inclusive Care for the Elderly) entity oversight by June 30, 2023.

• The regulatory plan must consider input from executive agencies, local governments, advocacy organizations, PACE participants and families, staffing practices, transportation data, audits and complaints, business continuity information, and appeal rights.

• State Department must establish, administer, and enforce minimum regulatory standards and rules for PACE programs and contracted entities by March 1, 2024, sufficient to ensure health, safety, and welfare of PACE participants.

• State Department must continually analyze PACE reimbursement methodology and provide updates to the House Public and Behavioral Health Committee, Senate Health and Human Services Committee, and Joint Budget Committee regarding new methodology requirements that incorporate encounter data.
