HB 23-1002: Epinephrine Auto-Injector Affordability

• Establishes an epinephrine auto-injector affordability program effective January 1, 2024, to provide low-cost epinephrine auto-injectors to eligible Colorado residents without insurance or assistance programs.

• Requires health insurance carriers to cap patient cost-sharing for prescription epinephrine auto-injectors at $60 for a two-pack, regardless of dosage or type, for plans issued or renewed on or after January 1, 2024.

• Mandates epinephrine manufacturers establish procedures to make auto-injectors available to eligible individuals and process pharmacy reimbursement claims within 30 days through either payment or replacement supply.

• Allows pharmacies to collect up to $60 copayment per two-pack and requires manufacturers to reimburse pharmacies for dispensed auto-injectors unless they provide replacement supplies.

• Appropriates $58,291 to the Division of Insurance for 2023-24 to implement the program, including application form development and promotional efforts in multiple languages.
