HB 23-1005 Summary

• Expands the New Energy Improvement Program to include resiliency improvements (seismic integrity, indoor air quality, wind/fire/flood durability, power outage resilience, storm water control, extreme temperature mitigation) and water efficiency improvements (reducing consumption or conserving/remediating water).

• Requires the New Energy Improvement District to develop guidelines detailing requirements for resiliency and water efficiency improvements to qualify for program financing.

• Eliminates the public hearing requirement for special assessments and instead requires the district to send notice of assessment to property owners and lienholders after the assessment roll is completed.

• Adds a requirement that notices include information that special assessments constitute a lien under state law and establishes an appeal process for denied complaints or objections.

• Streamlines notice procedures for residential properties where lien subordination is not sought by exempting certain title insurance and notice requirements from application.
