House Bill 23-1011 Summary

• Expands Colorado's right-to-repair law to cover agricultural equipment manufacturers, requiring them to provide documentation, parts, embedded software, firmware, tools, and data to independent repair providers and equipment owners on fair and reasonable terms.

• Defines agricultural equipment to include tractors, combines, sprayers, balers, and other farm equipment used for planting, cultivating, harvesting, or ranching, but excludes highway vehicles, powersports vehicles, agricultural aircraft, and irrigation-only equipment.

• Prohibits manufacturers from imposing substantial obligations or restrictions on parts and software use, or requiring registration or approval before equipment becomes operational, while allowing withholding of genuine trade secrets that don't diminish repair usability.

• Limits right-to-repair to prevent modifications that deactivate safety systems, cause emissions non-compliance, or evade copyright and patent laws, and shields manufacturers from liability for faulty repairs performed by independent providers.

• Becomes effective January 1, 2024, and automatically repeals if Congress enacts federal right-to-repair legislation for agricultural equipment; allows manufacturers under nationwide memoranda of understanding to maintain those agreements if they provide equal or greater rights than the law.
