HB23-1026: Grandparents' Rights for Aaliyah and Myah Act

• Establishes a legal framework allowing grandparents and great-grandparents to petition courts for "grandparent or great-grandparent family time" (visitation) with grandchildren or great-grandchildren when there is an active child custody or parental responsibility case.

• Creates a presumption that parental determinations regarding grandparent time are in the child's best interests, which grandparents can overcome only through clear and convincing evidence.

• Defines "family time" as any form of contact or engagement between grandparents/great-grandparents and grandchildren/great-grandchildren for purposes of preserving and strengthening family ties.

• Allows grandparents and great-grandparents to file petitions no more than once every two years unless good cause is shown, and permits courts to award attorney fees to the prevailing party.

• Establishes enforcement mechanisms for violations of grandparent family time orders, including makeup visitation, bond requirements, contempt findings, and reimbursement of actual expenses and attorney fees to aggrieved grandparents.
