HB23-1048 Summary

• Requires the Department of Transportation to stagger delineator posts (reflective steel rods marking road edges) at intervals of at least one-tenth of a mile on two-lane state highways where farming equipment and oversize loads actively operate, when practical and when reasonable safety standards permit.

• Directs the Department of Transportation to consider implementing flexible delineator posts and other engineering solutions to accommodate the needs of all vehicles, including large agricultural equipment.

• Applies to construction, repaving, or repair projects on two-lane state highways where oversize or farming loads are actively used.

• Does not require delineator posts to be placed where the Department of Transportation deems them unnecessary for safety.

• Takes effect 12:01 a.m. the day after the 90-day period following final adjournment of the general assembly, unless subject to a referendum petition filed by November 2024.
