HB 23-1050 Summary

• Extends deadly force protections to business owners, managers, and employees when an intruder makes an unlawful entry, matching protections previously available only to home occupants.

• Allows any person in lawful possession of a firearm at a place of business to use deadly physical force against an intruder under the same conditions as business owners and employees.

• Requires a reasonable belief that the intruder has committed or intends to commit a crime in addition to the unlawful entry, and that the intruder might use physical force.

• Provides criminal immunity and civil liability protection for individuals using such force in accordance with the law.

• Takes effect 90 days after adjournment, unless a referendum petition is filed, in which case it requires voter approval at the November 2024 election.
