HB23-1086: Due Process Asset Forfeiture Act

• Requires reporting of property type, make, model, serial number, estimated value, and net equity in asset forfeiture cases to a public searchable database.

• Expands database reporting to include forfeiture proceeding outcomes: whether the property owner defaulted, was found innocent, or property was forfeited by court order, settlement, or plea agreement.

• Appropriates $22,549 to the department of local affairs and $22,549 to the office of information technology (0.2 FTE) for the 2023-24 fiscal year to implement and maintain the database.

• Takes effect September 1, 2023, unless a referendum petition is filed within 90 days of final adjournment, in which case it becomes effective January 1, 2025, if approved by voters in November 2024.

• Applies to all seizures occurring on or after the effective date.
