The State Controller must promulgate fiscal rules allowing state agencies to provide advance payments for charitable food organizations to purchase Colorado-grown agricultural products using state grant money, subject to State Controller review.

"Charitable food organization" is defined as a charitable or faith-based organization exempt from federal taxation that distributes food for hunger relief, and includes school food authorities.

The fiscal rules may include requirements for proper accounting, compliance with industry standards, and verification that advance payments provide benefits to the state equal to or greater than the costs and risks involved.

The act takes effect 90 days after the general assembly adjourns, unless a referendum petition is filed, in which case approval by voters at the November 2024 general election is required.
