HB 23-1100 Summary

• Prohibits Colorado state and local governmental entities from entering into agreements to detain individuals in privately-owned, managed, or operated immigration detention facilities beginning January 1, 2024.

• Bans governmental entities from selling public property for private immigration detention facilities, subsidizing such facilities, or receiving per diem payments related to immigration detention operations.

• Allows local governments to continue contracting for health, utility, and sanitation services to immigration detention facilities.

• Requires governmental entities with existing immigration detention agreements on January 1, 2024 to exercise termination provisions by that date or as soon as possible thereafter.

• Takes effect 90 days after the 2023 legislative session concludes, unless a referendum petition is filed, in which case it requires voter approval at the November 2024 general election.
