HB23-1105 Summary

• Creates two task forces within the Department of Regulatory Agencies to examine homeowner rights issues: one for HOA communities and one for metropolitan districts, with members appointed by the Speaker, Governor, and legislative leadership by August 1, 2023 and November 1, 2023 respectively.

• HOA task force examines association fining authority, foreclosure practices, communications with homeowners, and document availability; metropolitan district task force examines tax levying authority, foreclosure practices, communications, governance policies, and potential transitions from metropolitan districts to common interest communities.

• Task forces must prepare initial findings with legislative recommendations by the second meeting for the 2024 session, with HOA task force submitting final report by April 15, 2024 and metropolitan district task force submitting interim report by March 1, 2024 and final report by June 15, 2024.

• Appropriates $208,408 to the Department of Regulatory Agencies for 2.0 FTE staff support and $1,887 to the General Assembly for legislator per diem and travel reimbursement for the 2023-24 fiscal year.

• Both task forces are repealed effective September 1, 2024 and June 15, 2024 respectively.
