HB23-1123 Summary

• Requires drivers to exhibit due care and caution when approaching or passing stationary motor vehicles displaying hazard signals with alternately flashing or warning lights.

• On highways with at least two adjacent lanes in the same direction, drivers must move into a lane at least one moving lane apart from the stationary vehicle, unless unsafe due to weather, road conditions, or traffic.

• On highways with fewer than two adjacent lanes or when lane movement is impossible, drivers must reduce and maintain safe speed with regard to the stationary vehicle's location, weather, road conditions, and traffic.

• Expands protections to include port of entry vehicles, authorized contractors of public utilities, and vehicles being equipped with tire chains.

• Takes effect 12:01 a.m. on the day following the ninety-day period after final adjournment of the general assembly, or upon voter approval in November 2024 if a referendum petition is filed.
