HB23-1127: Customer's Right to Use Energy

• Prohibits state agencies, local governments, and homeowner associations from limiting or prohibiting installation or use of natural gas, propane, solar photovoltaics, micro wind turbines (up to 100 kilowatts), or micro hydroelectricity (up to 100 kilowatts) in residences and businesses.

• Overrides any conflicting provisions in association declarations, bylaws, rules, regulations, or local ordinances that restrict energy system choices for electricity generation, cooking, heating water, or heating/cooling spaces.

• Defines "local government" as home rule or statutory counties, cities, city and counties, or metropolitan districts.

• Takes effect 12:01 a.m. on the day following the 90-day period after final adjournment of the general assembly, unless subject to a successful referendum petition, in which case it requires voter approval at the November 2024 general election.
