• Prohibits employers from taking adverse action against employees who accept cash gratuities offered by business patrons.

• Allows employers to require employees to share or allocate gratuities on a preestablished basis among employees.

• Exempts gaming industry employers, licensed professionals required to maintain licensure as employment condition, health-care facility employees, Program of All-Inclusive Care for the Elderly employees, and employees providing housing and services to seniors.

• Appropriates $38,436 to the Department of Labor and Employment for the 2023-24 fiscal year to implement the act, including 0.4 FTE for the Division of Labor Standards and Statistics.

• Takes effect 90 days after final adjournment of the general assembly, subject to voter approval if a referendum petition is filed.
