HB23-1173 Summary

• Requires voter approval at the November 2024 general election before taking effect on February 1, 2027.

• Replaces the 11-member appointed Transportation Commission with 9 elected members: one from each congressional district plus one at-large member (or all congressional districts if the number becomes odd).

• Transfers appointment power of the Department of Transportation executive director from the governor to the Transportation Commission, effective February 1, 2027, with the current director remaining in office until the Commission appoints a successor by July 1, 2027.

• Requires commission members to reside in their respective districts or the state at-large, with automatic resignation if they cease residency.

• Makes conforming amendments to election laws to treat Transportation Commission candidates and members the same as state board of education and university board of regents members regarding party committees, nominations, tie votes, election contests, and campaign finance disclosure.
