Department of Health Care Policy and Financing must engage in a stakeholder process by September 1, 2023, including program-approved service agencies, case management agencies, host home providers, individuals with lived experiences, and disability advocacy groups.

Stakeholder process must address grievance and complaint procedures for individuals receiving long-term services and supports, including timelines, appeal rights, notification requirements, and retaliation reporting mechanisms.

Stakeholder process must address the process for determining host home providers convicted of abuse or neglect ineligible to continue providing services, and ensure consistency of contract language between service agencies and host home providers.

Department must report findings from the stakeholder process as part of its SMART Act hearing required by January 2025, including identification of administrative resources needed to address identified concerns and solutions.

$75,000 is appropriated to the Department of Health Care Policy and Financing's Office of Community Living for the 2023-24 fiscal year from the general fund, with an anticipated $75,000 in federal funds for implementation.
