Effective July 1, 2024, health-care providers and health systems are prohibited from charging patients facility fees directly for preventive outpatient services not covered by insurance.

Facility fees remain permitted for inpatient services, hospital emergency departments, freestanding emergency departments, and when billed to insurers.

Health-care providers must provide transparent notice to patients about facility fees at appointment scheduling and service delivery, post bilingual signage, and provide itemized bills identifying facility fees separately.

Newly affiliated health facilities must notify existing patients within 12 months of affiliation about facility fee billing and cannot collect such fees for 30 days after notification.

Critical access hospitals, sole community hospitals in rural/frontier areas, and hospitals established under Article 29 of Title 25 are exempt from the outpatient facility fee restrictions.
