HB23-1221 Summary

• Requires the Division of Administration in the Department of Public Health and Environment to use quality-assured data when determining total maximum daily loads (TMDL) for state waters, effective January 1, 2024.

• Defines "quality-assured data" as scientifically accurate water quality data collected within the last five years (or most recent comparable period) that complies with state commission rules and federal/state guidance on data collection, analytical methods, and quality assurance.

• Defines "total maximum daily load" as the calculation of the maximum amount of pollutant that can be discharged daily into state waters without exceeding applicable water quality standards.

• Requires TMDL calculations to be conducted with comprehensive geographic and hydrogeologic accuracy.

• Takes effect January 1, 2024, unless a referendum petition is filed, in which case the measure requires voter approval at the November 2024 general election.
