HB23-1233 Summary

• Requires the State Electrical Board to adopt rules by September 1, 2023, mandating electric vehicle (EV) charging infrastructure in new multifamily buildings and major renovations effective March 1, 2024, based on the Model Electric Ready and Solar Ready Code.

• Prohibits private restrictions on EV charging and parking, allowing tenants and unit owners to install Level 1 or Level 2 charging systems on leased premises and assigned parking spaces, and forbids landlords from restricting parking based on vehicle being plug-in hybrid or electric.

• Requires counties and municipalities to count parking spaces served by EV charging stations as at least one standard parking space toward minimum parking requirements, and prohibits local governments from adopting ordinances prohibiting EV charging installation unless narrowly tailored for bona fide safety concerns.

• Exempts electric vehicle charging systems from business personal property tax for years 2023-2029 and authorizes the Department of Transportation to collaborate with public and private entities to develop EV charging systems along interstate and state highway rights-of-way.

• Standardizes the definition of "disproportionately impacted community" across multiple state statutes to align with criteria in Section 24-4-109, including income levels, housing cost burden, minority populations, and environmental justice considerations.
