HB23-1276 Summary

• Expands the Bridge and Tunnel Enterprise's authority to include preventative maintenance bridge projects for fair-rated and good-rated bridges, in addition to existing repair and reconstruction projects.

• Allows fair-rated bridges to be included in designated bridge projects when doing so results in cost savings, schedule acceleration, or improved safety.

• Defines "fair-rated bridge" and "good-rated bridge" as bridges on the state highway system rated accordingly by the department, including connected roadways and infrastructure.

• Authorizes the bridge enterprise to use revenue from bridge safety surcharges and impact fees to fund preventative maintenance projects and fair-rated bridge work included in larger projects.

• Takes effect 90 days after final adjournment unless subject to a referendum petition, in which case it requires voter approval at the November 2024 general election.
