HB 23-1285 Summary

• Requires stores to remit single-use carryout bag fees to their municipality or county on a quarterly basis, starting April 1, 2024.

• Allows stores to retain and use bag fees if a municipality or county has not established a process to accept remittances, requiring use of funds for purposes specified in subsections (1)(a)(I)(B) and (2)(a)(I)(B) of the statute and to purchase reusable bags.

• Deletes the April 1, 2024 start date language from the original statute, allowing the quarterly remittance requirement to begin immediately upon enactment.

• Includes a safety clause declaring the act necessary for the immediate preservation of public peace, health, or safety.
