HB23-1293: Colorado Felony Sentencing Reform

• Reduces felony classifications for numerous offenses, including third degree arson (Class 4 to Class 5), identity theft (Class 6 to Class 5), and criminal impersonation (varies by type)

• Eliminates or repeals certain statutes including aggravated robbery of controlled substances (Section 18-4-303), smuggling of humans (Section 18-13-128), and dueling (reduces from Class 4 felony to Class 1 misdemeanor)

• Modifies burglary classifications: second degree burglary of non-occupied structures reduced to Class 5 felony; introduces distinctions based on building type and commercial use

• Makes various crimes Class 6 felonies instead of Class 5, including false statements related to compensation claims, theft of medical records (unless information disclosed to unauthorized person), and criminal trespass on agricultural land without fencing

• Appropriates $32,170 to the judicial department for fiscal year 2023-24, with 0.4 FTE for probation programs and capital outlay; effective October 1, 2023
