HB23-1294 Summary

• Creates a Legislative Interim Committee on Ozone Air Quality with 12 members (6 senators, 6 representatives) to study ozone pollution factors, strategies, and solutions, with the committee repealing July 1, 2024.

• Requires the Air Pollution Control Division to promptly investigate written complaints alleging air quality violations and respond to complainants within 30 days outlining investigation steps; allows consideration of audio, video, and testimonial evidence.

• Strengthens enforcement by allowing civil penalties for violations that at minimum equal the economic benefit gained from the violation and allowing complainants to participate as parties in enforcement hearings.

• Requires the Oil and Gas Conservation Commission to promulgate rules by April 28, 2024 that evaluate and address cumulative impacts of oil and gas operations, including climate, public health, environmental, air quality, water quality, noise, odor, and wildlife impacts.

• Appropriates $1.06 million for fiscal year 2023-24 across multiple departments to implement the act, including funding for new positions in the air pollution control division and oil and gas conservation commission.
