HB23-1310 Summary

• Establishes civil infraction penalties for misusing a public safety answering point (PSAP) by purposefully initiating communication without reporting an emergency or new information about a previously reported emergency after being instructed to stop.

• Prohibits making false reports to PSAP representatives, knowingly obstructing PSAP administration, or making comments intended to intimidate or harass PSAP representatives.

• Authorizes PSAPs to issue written warnings (by text message or through local law enforcement) that must include section citation, violation description, date, time, and optional behavioral health resources.

• Establishes civil infraction violation subject to maximum fine of $100, regardless of whether a written warning was issued; permits referral to behavioral health services in lieu of citation if violation appears related to behavioral health issues.

• Takes effect 12:01 a.m. on the day following the 90-day period after final adjournment of the general assembly, unless subject to referendum petition requiring approval at November 2024 general election; applies only to offenses committed after effective date.
