Senate Bill 23-012 Summary

• Requires Colorado State Patrol to have exclusive enforcement authority to conduct safety compliance reviews of intrastate motor vehicle carriers and impose civil penalties in accordance with federal regulations as of October 1, 2001.

• Authorizes the Department of Revenue to cancel motor carrier registrations and deny vehicle registration renewals when carriers fail to pay civil penalties within 30 days or fail to cooperate with compliance reviews within 30 days.

• Requires the Department of Revenue to enter non-compliant motor carriers and their vehicles as out-of-service in the Federal Motor Carrier Safety Administration system of record.

• Exempts persons using independent contractors from liability for penalties imposed on contractors for equipment, acts, and omissions within the contractor's control or supervision.

• Appropriates $61,110 to the Department of Revenue for fiscal year 2023-24, with $52,200 for DRIVES system maintenance and $8,910 for information technology services, with implementation effective April 31, 2024, subject to voter approval if a referendum petition is filed.
