SB23-153 Summary

• Continues regulation of notaries public by the Secretary of State through September 1, 2032 (previously scheduled to sunset September 1, 2023).

• Establishes framework for use of interpreters in notarial acts, requiring interpreters to appear personally and prohibiting those with disqualifying interests (including family members or beneficiaries of the transaction).

• Increases maximum notary fees from $5 to $15 per document and from $10 to $25 for electronic signatures.

• Removes requirement that notary public commissions display expiration dates on certificates of notarial acts and requires certificates to indicate when interpreters were used.

• Appropriates $96,568 to the Department of State for fiscal year 2023-24, including $88,953 for 0.7 additional FTE staff and $7,615 for operating expenses.
