Senate Bill 23-164 Summary

• Continues the Sex Offender Management Board through September 1, 2028 (previously scheduled for repeal September 1, 2023), implementing recommendations from the 2022 Department of Regulatory Agencies sunset report.

• Expands sex offender definition to include persons evaluated at prosecuting attorney or court request who are determined to need treatment, and clarifies juvenile sex offender definitions to include those sentenced after age 18.

• Requires the board to perform compliance reviews of at least 10% of treatment providers biennially and revise the sex offender release guideline instrument with risk-need-responsivity concepts by December 1, 2023.

• Establishes a subcommittee by July 31, 2023 to analyze Department of Corrections data on inmates eligible for sex offender treatment, identify barriers to treatment access, and report recommendations to legislature by February 1, 2024.

• Appropriates $163,946 to the Division of Criminal Justice and $43,122 to the Judicial Department for the 2023-24 fiscal year to implement the act and improve sex offender treatment and supervision.
