SB 23-168 Summary

• Repeals Part 5 of Article 21 of Title 13 and creates the "Jessi Redfield Ghawi's Act for Gun Violence Victims' Access to Justice and Firearms Industry Accountability"

• Establishes standards requiring firearm industry members to comply with Colorado Consumer Protection Act and prohibits knowingly engaging in unfair or deceptive trade practices and violations of Article 12 of Title 18

• Allows persons harmed by firearm industry violations and the Attorney General to bring civil actions for injunctive relief, compensatory and punitive damages, attorney fees, and other appropriate remedies within five years of the violation or harm

• Creates a presumption that a firearm industry member's knowing violation is the proximate cause of harm when the violation creates a reasonably foreseeable risk of injury, notwithstanding any intervening acts by third parties

• Takes effect October 1, 2023
