Health benefit plans cannot use body mass index (BMI), ideal body weight, or achieved weight standards as sole determinants of medical necessity or appropriate care level for eating disorder patients, effective January 1, 2024.

Medical necessity assessments for eating disorders must consider eating behaviors, need for supervised meals, laboratory results (heart rate, kidney/cardiovascular function, blood pressure), recovery environment, and co-occurring disorders.

State medical assistance program prohibited from using BMI or weight standards for eating disorder coverage decisions beginning July 1, 2023, with same alternative criteria requirements.

Retail establishments cannot sell over-the-counter diet pills to persons under 18 years of age, effective July 1, 2024; violations constitute deceptive trade practices.

Retail establishments must request valid identification from anyone appearing under 18 who attempts to purchase over-the-counter diet pills.
