SB23-188 Summary

• Prohibits Colorado medical malpractice insurers and health insurance carriers from denying, canceling, or penalizing providers solely for offering legally protected reproductive health care or gender-affirming care.

• Prevents Colorado state agencies from providing information or resources to assist out-of-state investigations or prosecutions of individuals for legally protected health-care activities that are lawful in Colorado.

• Protects health-care providers and patients from arrest, extradition, subpoenas, search warrants, and wiretapping related to legally protected reproductive or gender-affirming health-care activities.

• Establishes that reproductive health-care facilities are permitted uses for zoning purposes in any zone allowing general outpatient health-care services, and expands the address confidentiality program to include reproductive health-care workers and patients.

• Defines "legally protected health-care activity" to include seeking, providing, or assisting in obtaining reproductive health care and gender-affirming services that are lawful in Colorado, including care provided to out-of-state patients.
