Removes the requirement that the Division of Insurance wait for federal determination that fertility coverage does not require state cost defrayal, instead mandating coverage for individual and small group health benefit plans issued or renewed on or after January 1, 2025.

Prohibits health benefit plans from imposing exclusions, limitations, or other restrictions on fertility services coverage based on a covered individual's participation in fertility services provided by or to a third party.

Amends the definition of "infertility" to include a "status" in addition to a disease or condition.

Maintains existing requirement that health benefit plans cover fertility diagnosis and treatment and standard fertility preservation services.

Takes effect 90 days after final adjournment of the general assembly, subject to voter approval if a referendum petition is filed before the November 2024 general election.
