HB 24-1073 Summary

• Expands the Independent Ethics Commission's jurisdiction to include school district and special district officials and employees, who were previously excluded from its oversight.

• Defines "school district official" as a member of a school district's board and "school district employee" as temporary or permanent employees appointed by and reporting to the board.

• Defines "special district official" as a member of a special district's board and "special district employee" as temporary or permanent employees appointed by and reporting to the board; excludes certain entities organized under Articles 8, 20, 25 of Titles 29, 30, 31 and Articles 41-50 of Title 37.

• Grants the Independent Ethics Commission authority to hear complaints, issue findings, assess penalties, and issue advisory opinions on ethics issues arising under Article XXIX of the state constitution and other applicable standards of conduct for these officials and employees.

• Takes effect 90 days after final adjournment of the general assembly, unless subject to a referendum petition, in which case it requires voter approval at the November 2024 general election.
