HB 24-1224 Summary

• Defines "person" to include a living unborn human child from fertilization (fusion of sperm and egg) for purposes of private right of action, neglect, homicide, and assault provisions.

• Supersedes any existing state law relating to prenatal neglect, homicide, assault, or abortion regulations that conflicts with or is inconsistent with the bill.

• Makes the duress defense available for first-degree murder charges if the victim is a living unborn human child and the defendant is the child's mother.

• Authorizes the state to disregard any federal court decision that enjoins or voids the bill and subjects Colorado judges to impeachment or removal if they attempt to enjoin, stay, or void the bill's requirements.

• Applies to crimes committed on or after the effective date of the act, with a crime considered committed before the effective date only if any element occurs before that date.
