HB 24-1247: Digital Education Materials Integrity

• Public school contracting entities must include a termination clause in contracts with curated digital research collection vendors effective July 1, 2024, allowing contract termination if the collection contains advertisements, promotions, or embedded links directing students to harmful material on 3 separate occasions.

• All vendors must certify that curated digital research collections are free of advertisements, promotions, or embedded links or URLs, and must remove flagged harmful material within 3 business days of notice.

• School employees, contractors, and volunteers must report harmful material; students, parents, guardians, legal custodians, and community members may report incidents using the collection name, document title, reference number, or keywords to access it.

• Public schools must annually notify interested parties of reporting procedures and disclose details of any contracts with public libraries promoting collections to school boards and parents via email, including notification of material changes.

• The Department of Education must annually report to the General Assembly on the total number of reported incidents involving harmful material in digital collections.
