• Prohibits price gouging in rental housing during declared disasters within designated areas that experience a material decrease in residential housing units.

• Defines "price gouging" as rent increases exceeding the greater of the prior year's percentage increase or 10 percent for dwellings on the market pre-disaster, or rent more than 10 percent higher than similar pre-disaster dwellings for new rental listings.

• Applies during the "disaster period," defined as one year from the date of a presidential national emergency declaration or gubernatorial disaster emergency declaration.

• Allows the Attorney General, District Attorney, or affected tenants to enforce violations; tenants may sue for actual damages, statutory damages, attorney fees, and costs.

• Establishes that violations constitute unfair and unconscionable acts or practices under Colorado consumer protection law.
