HB24-1362 Summary

• Creates statewide authorization for graywater treatment works and use by default, allowing persons to install and use graywater systems in accordance with state water quality control commission rules adopted under section 25-8-205(1)(g).

• Permits counties and municipalities to opt out by adopting a resolution or ordinance prohibiting all graywater use or specific categories of graywater use, and requires them to notify the Division of Administration within the Department of Public Health and Environment of any such prohibitions.

• Restricts indoor graywater treatment works installations to new construction projects unless a local government adopts a resolution or ordinance to allow existing construction projects.

• Requires local governments that allow graywater use to adopt building codes preventing graywater from entering potable water systems and to report planned graywater system installations to local water utilities for tracking backflow prevention devices.

• Takes effect January 1, 2026, subject to a potential referendum petition that would require voter approval at the November 2024 general election for the act to take effect.
