Requires declarations creating common interest communities to be executed by or with express written authorization of the record owner of the real property, as shown by county clerk and recorder records.

Requires amendments to declarations that add real estate to an existing common interest community to be executed by or with express written authorization of the owner or owners of the real estate being added.

Clarifies that declarations must be executed like deeds and that the equitable remedy of reformation is available to correct errors in execution or contents of documents affecting real property.

Applies only to declarations executed or amended on or after the effective date of the act.

Becomes effective 90 days after final adjournment of the general assembly, unless a referendum petition is filed, in which case it requires voter approval at the November 2024 general election.
