HB 24-1449: Colorado Sustainability Act Summary

• Repeals and updates the "Pollution Prevention Act of 1992" and creates the "Colorado Sustainability Act" to establish a comprehensive framework for advancing sustainability and circular economy efforts throughout Colorado.

• Merges the Recycling Resources Economic Opportunity Program and Front Range Waste Diversion Enterprise into a new Colorado Circular Communities Enterprise, governed by a 13-member board appointed by the Department of Public Health and Environment Executive Director.

• Creates the Colorado Circular Communities Cash Fund financed through user fees collected at solid waste disposal sites (14 cents per cubic yard for commercial vehicles; 2-4 cents for personal vehicles) and redirects littering fine revenues to the fund.

• Authorizes the Enterprise to provide technical assistance, grants, loans, rebates, and funding to eligible entities (local governments, nonprofits, for-profit businesses, schools, and higher education institutions) to promote waste diversion, composting, recycling, and circular economy development statewide, with emphasis on equitable rural distribution.

• Establishes the program through September 1, 2032, with an annual reporting requirement to the General Assembly and a stakeholder feedback mechanism; takes effect July 1, 2024.
