Senate Bill 24-005 Summary

• Adds Article 99 to Colorado law prohibiting installation of nonfunctional turf, artificial turf, and invasive plant species on applicable property (commercial, institutional, industrial, common interest community property, and street rights-of-way) starting January 1, 2026.

• Local entities must enact ordinances by January 1, 2026 to regulate new development and redevelopment projects that disturb more than 50% of landscape area on applicable property.

• State facilities must comply with the prohibition for construction or renovation projects with designs commencing on or after January 1, 2025.

• Exempts residential property, allows maintenance of existing nonfunctional turf installed before compliance dates, permits native grass seed or sod hybridized for arid conditions, and allows artificial turf on athletic fields of play.

• Act takes effect 90 days after legislative adjournment unless a referendum petition is filed, in which case it requires voter approval at the November 2024 general election.
